Subject: Retiree Healthcare Participant Update
We are fully filed on our Motions for Class Certification and Preliminary Injunction, and the City’s final reply in support of its motion to dismiss is due this week.
Judge Holderman has struck the status hearing from November 12, and advised us this morning that he will rule electronically.
We, of course, will advise you whenever we receive something from the court.
However, if there is no ruling on anything by the end of next week, we will try to get the injunction back on a front burner, since I know you all have decisions you have to make.
For the moment, however, DO NOT GO TO COURT on November 12.
