Dear Participants:



The Court of Appeals has set arguments for December 10, 2014 at 930 AM at the Federal courthouse, 219 south Dearborn, Courtroom 2721.



While you all need not come, you are certainly welcome to attend, watch and listen. And I think it would be good for a number of you to attend,

because it shows there is real interest from real people, not just lawyers in the case.



I also don’t think we should pack and overwhelm the court with people. Although these judges (there will be three on the panel) are not easily

intimidated, by the same token, I don’t want them to feel like we’re trying to intimidate them either.



So, if you’d like to attend, and really will be coming, I’d appreciate it if you would email me that you are coming, so that I can get a feel for

how many are likely to show up. If there are really a lot of you, I might ask the court clerk to set up an overflow room as well.



PS: the court has extended the due date for our reply brief to November 14, 2014. When it’s filed, we’ll email you a copy and post it on our website.

PPS: As we’re in the preparation for a major battle, we would appreciate your considering additional contributions at this time too!
